"The Judiciary Act of 1789 set the number at six: a chief justice and five associate justices. In 1807, Congress increased the number of justices to seven; in 1837, the number was bumped up to nine; and in 1863, it rose to 10. In 1866, Congress passed the Judicial Circuits Act, which shrank the number of justices back down to seven and prevented President Andrew Johnson from appointing anyone new to the court. Three years later, in 1869, Congress raised the number of justices to nine, where it has stood ever since. In 1937, in an effort to create a court more friendly to his New Deal programs, President Franklin Roosevelt attempted to convince Congress to pass legislation that would allow a new justice to be added to the court—for a total of up to 15 members—for every justice over 70 who opted not to retire. Congress didn’t go for FDR’s plan."

There are 12 justices on the United Kingdom Supreme Court. There are 9 justices on the Canadian Supreme Court.
 
Expanding the Supreme Court sets up long term disaster again for the democrats. Short term things be fixed long term they are screwed like the 2013 vote change.

Democrats fall in to these delusions that can keep the presidency for decades as the vanquished the great evil...

But us politics is never like that.
 
If Trump loses and they decide to do this, it really is a declaration of war. The Dems will be angry and control presidency and likely the Senate, They would want to pack the court.

Interesting strategy would be for GOP to tell their base if you want that SCOTUS seat better re-elect Trump and Senate.

More to the point...

If there is a disputed election like in 2000 it won't reflect well on Republicans if they confirm a trump supporter to the supreme court.

Right now the optics are bad.. very bad for nominating anyone before inauguration day. Put in the wrong person and it could look very bad in a worst case scenario.

Best to leave it vacant rather than stack the court.

There was no major vote change in 2013 - in fact the nuclear option was avoided and the Supreme Court nomination is specifically excluded from changes. Republicans didn't have such qualms in 2017 - they removed that exception via the nuclear option.

I don't think the GOP as it stands right now gives an iota about optics - it's power to its' own end, at all cost kind of mechanics one is dealing with here. How many high constitutional principles (e.g. judicial independence from the executive, etc) have they already repudiated?

Senate Majority Leader McConnell has issued a statement on the passing of RBG.

He managed to squeeze in lines that imply he will bring any Trump nominee to SCOTUS to the floor for a vote ASAP.

Colins was toast anyway. The Con side don’t care about winning in 2020, they know with Trump it’s a long shot. The Cons want longterm power, and that’s achieved through the SCOTUS. So, Trump rams through an evangelical jurist, she takes her seat, then Trump loses and says as he’s walking out, “I did my best, the Supreme Court is now ours. It’s up to you to finish the job at the 2022 midterms and to remove that nasty woman from the White House in 2024!”

The culture and coming climate war in the US makes me want to make the Covid border closures permanent.
 
But if they lose the presidency and the Senate, have they really secured SCOTUS?
 
The Dems can make their own vacancies (lots of them). And you better believe that if SCOTUS starts allowing abortion bans to stand it would happen.
