    So, if top floors are scheduled to move in on March 13, that's probably close to the last of the bunch. Once delay issue's are resolved, they can't just have everyone take occupancy the same day..... so.... could be a ways out

    You are right. I think he can manage the capital gains with some finagling anyway. Will recommend talking to a real estate / tax lawyer for advice.
