Hello, Good Morning. The letter received is worded to sound like here is what we (receiver) have to offer to help you decline the offer (LOL). the mute message is please go ahead and refuse the amended APS they would proceed with the amended APS if you decide not to cancel.
what is the latest outside occupancy date?
So is basically a letter giving u new price and if decided then will give a full updated APS? Suppose you want have a lawyer analyze before you sign new APS? Need see builders fees and exps etc bs

Only issue with this is providing KSV secures all the updated APS , after last hearing i asked Meg and she emailed below info..so how can they assured that date.. unless the loan providers take over the project..and have presale etc..

“As advised to the Court at the hearing on October 15, 2024, in the event that there are not enough secured APSs to get construction financing, KSV will be back to the Court to seek further direction or provide further recommendations.”

You are right Dan, Even KSV knows that this is uphill task for them to secure any kind of positive response from the existing members of UPtowns given such a high increase in APS. I think they know it for sure that people will opt out automatically and then the court will award the project to new Builders without having to carry the burden of pre-existing Vndayak APS. They have even mentioned that n the letter some body from Capital Real Estate will get in touch with or can have an appointment

Anything about interest on the APS?
 
I believe the reason they are sending this in batches is to pressurize the people not to cancel the contract. If all amended contracts are sent on same time to 200 buyers. They might not have time to pressurize everyone.

Well they can release a new batch anytime soon…..this could drag on for months
