I was trying to find the reference to the appeal ground (delay). Where can I find direct reference to that?

The City's review is pretty comprehensive. The developer's plans ignore pretty much every rule about massing and density - right down to ignoring visual stepbacks after five floors, not establishing a proper streetscape and ignoring the 45 degree rule at the back. Arguing against an additional 30' of height is not NIMBY-ism, especially when nobody is objecting to matching the height of existing condos on the block. The developer hasn't done their job of explaining why it's appropriate to exceed the plan by 50%.

It's also a bit rich for the developer to complain about delays when they haven't submitted all the updated docs for their revised plan. For those in the know, does this appeal have legs? Will the OMB give them everything the developer wants because the City didn't respond in time, or is this just a technicality by the City because they knew it would end up at OMB regardless?

From the prehearing decision:
[13] Based on the submissions heard today, the Board determines that it is appropriate to schedule an eight day hearing in the early part of 2018. The parties are directed to contact the Case Coordinator to schedule a convenient hearing time within the early part of 2018, depending upon the Board’s calendar availability. The Board will subsequently advise all parties and participants of the scheduled hearing date.
No hearing has been scheduled yet.

The unfortunate thing is that most residents are so uniformed about basic things in this city, so they buy this kind of non-sense. These days, as long as you can make something up that makes a moderate amount of sense, someone will believe you even if it's not true.
