If I recall correctly, another factor was that the owners of the banner saw the many higher banners recently raised in the area and applied for and received a minor variance allowing them to raise theirs.

What grinds my gears even more than banner height-related broken promises are flag height-related broken promises; just look at how the top floors are obscured by the westernmost flag—unacceptable.
