The former car wash. Found it interesting to see a portion of the development for a senior's residence: 209 residential condominium units and 59 senior retirement units.

The proposed development is not consistent with the Provincial Policy Statement (2014) and does not conform with the Growth Plan for the Greater Golden Horseshoe (2017). Intensification and redevelopment is to be balanced with other applicable policies and criteria. In its current form, the proposal does not meet the criteria in Section 2 of the Planning Act and does not conform with the City's Official Plan or applicable guidelines.

Planning staff have identified concerns with the proposal described in this report with respect to building height, density, built form, massing, setbacks and its relationship to adjacent properties and the public realm. These issues and all additional matters that arise through the development review process will need to be addressed prior to submission of a Final Report to City Council. While staff will continue to work with the applicant to address the issues, and due to the Community and City Council break, it is recommended that City Council direct the City Solicitor and appropriate City staff to attend and oppose the application in its current form should the application be appealed to the Local Planning Appeal Tribunal (LPAT) on the basis of City Council's failure to make a decision on the application within the statutory timeframe of the Planning Act.

The date of complete application is significant in HS4 Finch’s view because if it is the earlier date, then it would have been entitled to file an appeal of the City’s failure to make a decision on its application prior to April 3, 2018. Its appeal would therefore be subject to the Ontario Municipal Board Act, R.S.O. 1990, c. O.28 (the “OMBA”) as it read prior to its repeal on April 3, 2018. If the City’s date is correct, HS4 Finch submits that its appeal will be subject to the Local Planning Appeal Tribunal Act, 2017, S.O. 2017, c. 23, Sched. 1, as amended (“LPATA”), which was proclaimed on April 3, 2018, and provides for a more limited hearing process and basis for appeal.

The applicant filed a motion to have the LPAT determine when the application was complete, but the LPAT found that it was not in a position to do so.
