Theoretically, could a lane by changed to parking and a few years later changed to a bike lane and be clear of this law? Maybe we don't know at this point.

If the City passed the relevant by-laws prior to the provincial legislation on cycle tracks, then it can go ahead.
Regardless, the province is unconcerned with a street like Portland.

I think a street like Portland is exactly what Ford is referring to when he says cyclists should be on secondary roads.

P.S. I know this is petty, but if the bike lanes get removed there should be a compete street parking ban on Bloor there and these business can cry about it, after all the rationale is to get cars moving (not standing still).

I don't see how this doesn't get dismissed with costs awarded.
Its the City's road, absent provincial legislation to the contrary, the City can do with it as it pleases, make it one-way, ban turns, add or remove lights, to the best understanding I have this discretion is black letter law.
There is no right to a set number of lanes of traffic, or a particular speed limit etc.
Set aside the issue of the bike lanes, allowing this suit to go forward would create an unholy mess for every municipality in Ontario. It would open any and every project of all types to armchair quarterbacking.

Completely right. Even if they draw a judge who lives on the Kingsway and drives everywhere, this gets tossed.
