Perhaps, but the City has continued to maintain the underlying industrial zoning designations for most of Liberty Village, including this property. Over time, the City has just layered on additional residential and commercial permissions and has intentionally not eliminated industrial-type uses due to the area's industrial heritage. The consequence is that the proposed height, density, and setbacks of this self-storage project all appear to be permitted as-of-right under applicable zoning regulations.

Perhaps the City should consider using its enormous cash-in-lieu-of-parkland fund to acquire the property and expand the proposed park? It's unreasonable to expect a developer not to implement what's already permitted under the City's zoning regulations.
