ELM Developments has rebranded this project as 'Spruce Trails' and submitted a new Site Plan Application with changes to the parking layout, landscaped areas, and amenity spaces. Revised construction permits were issued in December 2025. The database has been updated to reflect the new plan.

Hello, has anybody received a new APS or any update whose outside occupancy date is 13 March 2026?
Hello, I was out of the country and only got back early this morning. I do see 2 emails from Marleigh Dick of Osler with some attachments. Did not have a chance to read these documents. Does anyone know what is going on?

The parties have applied to the court for an Amendment Relief Order, which would remove the automatic termination of the APS (Agreement of Purchase and Sale).
KingSett Mortgage Corporation has purchased the Uptown project and intends to negotiate with the 31 remaining APS purchasers to encourage them not to terminate their APS agreements.
However, the Amendment Relief Order will not interfere with the existing rights of the purchasers under the remaining APSs. The counterparties will still retain their right to terminate their Uptown APSs during the Termination Period, if they choose to do so.

The termination notice for the Agreement of Purchase and Sale (APS) must be delivered within the termination period, which commences after March 13, 2026, and expires on April 13, 2026.

Yes I get that but they are seeking a motion tomorrow March 11th to negotiate with the remaining 31 buyers. Should they not also simultaneously advise about the process to terminate the APS for those who wish to do so since they can't deliver the homes on March 13th?

I believe they will contact everyone after the motion is approved. Let's wait and see what the next steps will be. They will likely provide further advice at that time.
